1. Parties and Scope

These Terms of Use (the "Terms") govern the conditions of use between the developer identified below (the "Developer", "we", "us") who provides the Velum. - Quotes mobile application and related services (the "Application", "Service"), and the natural person who uses the Application (the "User", "you").

By downloading, creating an account on, or using the Application, you represent that you have read, understood, and accepted these Terms. If you do not accept these Terms, you must not use the Application.

If you obtained the Application through the Apple App Store or Google Play, the terms of use of the respective store also apply. For matters not expressly addressed in these Terms, the standard agreements of the store from which you obtained the Application — for Apple, the Licensed Application End User License Agreement (Apple Standard EULA) and the Apple Media Services Terms and Conditions, and for Google, the Google Play Terms of Service — shall apply. In the event of any conflict between these Terms and the terms of the relevant store, the terms of that store shall be deemed to prevail within their own scope. 2. Description of the Service

Velum. - Quotes is a mobile application that offers daily aphorisms and philosophy content, presenting that content under the headings of theme, thought (mood), philosopher, and daily edition. The Application includes features such as saving content, receiving daily notifications, multi-language support, and an optional paid "Pro" subscription.

The Developer reserves the right to modify, improve, or discontinue the features, content, and presentation of the Application without prior notice.

3. Account Creation and Use

You may use certain features of the Application as a guest (anonymous) user without creating an account. For cross-device synchronization and the protection of your data, you may create an account using Sign in with Apple, Sign in with Google, or email/password.

When creating an account, you agree to provide accurate and current information, to safeguard the security of your account (particularly your password), and that you are responsible for all activity carried out through your account. If you become aware of any unauthorized use, you must notify us at contact@berryfilm.art.

In guest (anonymous) use, your data is tied only to the session on that device; if you delete the Application or lose the device, you may lose access to your guest account and the data associated with it (e.g., saved items, subscription mapping). For this reason, we recommend that you create a permanent account.

4. Age Restriction

The Application offers content intended for a general audience. If you are under 18 years of age, you may use the Application only under the supervision and with the consent of your parent or legal guardian. We do not knowingly collect personal data from children without the required consent. If you believe that a child has provided us with data without consent, please contact us at contact@berryfilm.art.

5. Paid Subscription (Velum. - Quotes Pro)

5.1. Free and Pro

The Application offers a free ("Free") version and a paid ("Pro") subscription. In the Free version, the daily edition and core features are available; features such as unlimited access to all categories, an ad-free experience, and unlimited content saving are exclusive to the Pro subscription. The number of items that can be saved in the Free version is limited (40 in the current version).

5.2. Purchase, Price, and Renewal

The Pro subscription is purchased on a monthly or annual basis through the Apple App Store or Google Play. Purchase, payment, billing, renewal, and refunds are carried out by the relevant app store under its own terms (the Apple Media Services Terms and Conditions for Apple, and the Google Play Terms of Service for Google); the Developer does not see or store your card or payment information. With respect to subscription terms, the relevant store's rules on subscriptions apply to all matters not addressed in these Terms.

Current prices are displayed in the app store at the time of payment and on the payment screen within the Application. A promotional free trial period may be offered for the annual plan. Unless cancelled by you or by the store, the subscription automatically renews at the end of each period and the fee is charged to your store account.

5.3. Cancellation and Refund

You may cancel your subscription at any time through the account/subscription settings of the app store you use. Cancellation takes effect at the end of your current period; you continue to enjoy Pro features until the end of the period.

Refunds are subject to the refund policies of the relevant app store and are requested directly through the store. The Developer is not authorized to issue refunds for purchases made through the store. Your rights arising from consumer protection legislation are reserved.

5.4. Free Trial

Where a free trial is offered, if you do not cancel your subscription during the trial period, the subscription will automatically convert to the paid period at the end of the trial.

6. Intellectual Property Rights

All content in the Application — including aphorisms, compilations, attributions, descriptions, images, design, the logo, the "Velum." brand, software, and arrangements — belongs to the Developer or its licensors and is protected by copyright and intellectual property legislation.

The Developer grants you a limited, non-exclusive, non-transferable, and revocable license to use the Application for your personal and non-commercial use. Under this license, you:

Some aphorism and thought texts may have been compiled from public-domain works or from expressions attributed to historical figures; the rights in the compilation, arrangement, translation, and presentation of these texts belong to the Developer.

• may not copy, reproduce, distribute, sell, rent, or create derivative works from the Application or its content;
• may not reverse engineer, decompile the software into its source code, or circumvent its security measures;
• may share content only through the sharing features provided by the Application and for personal purposes.

7. Acceptable Use

You agree not to use the Application in any manner contrary to applicable legislation, in a way that infringes the rights of others, in a way that harms the Service's infrastructure (e.g., automated data scraping, excessive load, unauthorized access), or for any purpose outside the intended purpose of the Application.

8. Third-Party Services

The Application uses third-party services such as Google Firebase (authentication, database, analytics, notifications, storage), Google AdMob (advertising), and the Apple and Google sign-in and subscription infrastructures. Use of these services is also subject to the respective third parties' own terms and policies. In the Free version, advertisements may be displayed through Google AdMob; the Developer has limited control over the content and targeting of advertisements. 9. Special Conditions Relating to Apple and Google

The following provisions apply according to the store from which you obtained the Application and supplement the terms of the relevant store:

• Party to the agreement: These Terms are solely between you and the Developer; Apple and Google are not parties to these Terms. The Developer is responsible for the Application itself.
• Maintenance and support: The obligation to provide maintenance and support for the Application rests with the Developer; Apple and Google have no maintenance or support obligation whatsoever.
• Warranty: In the event the Application fails to conform to the terms, for versions obtained from Apple, Apple may — to the extent permitted by applicable legislation — refund the price paid; otherwise, all claims and obligations relating to the Application are directed to the Developer.
• Claims and intellectual property: Claims relating to the Application, including those concerning product liability, non-compliance with legislation, consumer/privacy legislation, and intellectual property infringement, are directed to the Developer; Apple and Google are not responsible for such claims.
• Third-party beneficiary: Apple and its subsidiaries are third-party beneficiaries of these Terms with respect to the Apple App Store version and have the right to enforce the Terms against you.
• Compliance representation: You represent that you are using the Application in a location that is not subject to U.S. export controls and is not on any embargo lists, and that you will comply with the terms of the relevant store and third-party services.

10. Content and Disclaimer

The aphorisms, quotations, attributions, philosopher profiles, "meaning/interpretation" texts, and other content in the Application are compiled and edited for informational, inspirational, and reflective purposes. This content does not replace professional (medical, psychological, legal, financial, etc.) advice and must not be used as such.

A significant portion of the content consists of sayings attributed to historical figures or compiled from works in the public domain. The genuine authorship, original context, dating, or literal accuracy of these sayings cannot always be guaranteed; some may be traditionally attributed, adapted, abridged, or of disputed authorship. The Application's content is offered in multiple languages; these translations were prepared in part with AI-assisted tools and may contain errors, omissions, or differences in meaning from the original. Translations and interpretations are editorial.

The views and ideas expressed in the aphorisms belong to their respective original authors or sources; they do not reflect the Developer's views and do not imply endorsement of any person, opinion, belief, or movement. The content may encompass differing philosophical, religious, and cultural perspectives.

The Developer does not warrant the accuracy, completeness, or currency of the content and may change, correct, or remove it without prior notice. The Developer cannot be held liable for the consequences of decisions you make in reliance on the content. 11. Limitation of Liability

The Application and its content are provided "as is" and "as available". The content is intended for informational, inspirational, and personal-development purposes; it does not constitute professional (medical, psychological, legal, etc.) advice and must not be used for such purposes.

To the maximum extent permitted by applicable legislation, the Developer does not warrant that the Application will operate uninterrupted or error-free, or that the content will at all times be complete or accurate. The Developer cannot be held liable for any indirect, incidental, or consequential damages arising from the use of the Application. This provision does not affect liabilities that cannot be limited under applicable legislation (e.g., intent or gross negligence).

12. Suspension and Termination

In the event of your breach of these Terms, we may suspend or terminate your account's access to the Service. You may also, at any time, delete your account using the "Delete my account" option within the Application, or end your use by uninstalling the Application. Upon termination, provisions that by their nature should survive (e.g., intellectual property, limitations of liability) remain in effect.

13. Changes

We may update these Terms from time to time. For significant changes, we will provide notice within the Application or by another appropriate method. Your continued use of the Application after the changes take effect means that you accept the updated Terms.

14. Governing Law and Jurisdiction

These Terms are governed by the laws of the Republic of Türkiye. The courts and enforcement offices of Ankara shall have jurisdiction over any disputes that may arise from these Terms. Your rights, as provided by legislation in your capacity as a consumer, regarding jurisdiction and avenues of recourse are reserved.
